Animal Rights.. Again! (Hadith No. 2062)

Bismillah.

Volume 3, Book 40, Number 565 :
Narrated by Abu Huraira (radiallaahu `anhu)
The Prophet (sallallaahu `alayhi wasallam) said, “One of the rights of a she-camel is that it should be milked at a place of water.”

Prophet (sallallaahu `alayhi wasallam) being the role model that he was, showed us and told us how to live our lives – how to worship Allah, how to behave, how to treat others, how to eat, sleep, drink etc. He even told us how to treat animals – being kind to them and showing mercy upon them. He said (authenticity of narration unknown):

“Fear God in regards to these animals who can not speak their will.  If you ride them, treat them accordingly (by making them strong and fit for that), and if you [plan to] eat them, treat them accordingly (by making them fat and healthy).” (Abu Dawud)

The Brave Girl (Hadith No. 1996)

Volume 3, Book 38, Number 499 :
Narrated by Abu Said Al-Khudri and Abu Huraira (radiallaahu `anhumaa)
Allah’s Apostle (sallallaahu `alayhi wasallam) employed someone as a governor at Khaibar. When the man came to Medina, he brought with him dates called Janib. The Prophet (sallallaahu `alayhi wasallam) asked him, “Are all the dates of Khaibar of this kind?” The man replied, “(No), we exchange two Sa’s of bad dates for one Sa of this kind of dates (i.e. Janib), or exchange three Sa’s for two.” On that, the Prophet (sallallaahu `alayhi wasallam) said, “Don’t do so, as it is a kind of usury (Riba) but sell the dates of inferior quality for money, and then buy Janib with the money”. The Prophet (sallallaahu `alayhi wasallam) said the same thing about dates sold by weight.

Today’s Hadith:

Volume 3, Book 38, Number 500 :
Narrated by Ibn Ka’b bin Malik from his father (radiallaahu `anhu)
We had some sheep which used to graze at Sal’ (a mountain in Madinah). One of our slave-girls saw a sheep dying and she broke a stone and slaughtered the sheep with it. My father said to the people, “Don’t eat it till I ask the Prophet (sallallaahu `alayhi wasallam) about it (or till I send somebody to ask the Prophet).” So, he asked or sent somebody to ask the Prophet (sallallaahu `alayhi wasallam), and the Prophet (sallallaahu `alayhi wasallam) permitted him to eat it. ‘Ubaidullah (a sub-narrator) said, “I admire that girl, for though she was a slave-girl, she dared to slaughter the sheep. “

Allaah says (interpretation of the meaning): 

“Forbidden to you (for food) are: Al‑Maitah (the dead animals — cattle — beast not slaughtered), blood, the flesh of swine, and that on which Allaah’s Name has not been mentioned while slaughtering (that which has been slaughtered as a sacrifice for others than Allaah, or has been slaughtered for idols) and that which has been killed by strangling, or by a violent blow, or by a headlong fall, or by the goring of horns — and that which has been (partly) eaten by a wild animal — unless you are able to slaughter it (before its death).”

[al-Maa’idah 5:3] 

Ibn Katheer said:  

The phrase “unless you are able to slaughter it” refers to that which you are able to reach and slaughter in the proper manner when there is still evidently life in it. That refers to the phrase, “that which has been killed by strangling, or by a violent blow, or by a headlong fall, or by the goring of horns — and that which has been (partly) eaten by a wild animal”. 

Tafseer Ibn Katheer, 2/11, 12

This shows that as long as one is able to slaughter the animal before it dies, it is permissible to eat from it. More on the etiquette of slaughtering animals here.

As for the brave girl who slaughtered the dying sheep, I admire her too! In fact, I admire all the women, including my mom, who are able to slaughter their sacrificial animals on Eid or otherwise. It takes guts to do it! Some women can’t even watch an animal being slaughtered let alone doing it themselves. SubhanAllah! May Allah give us (the scared lot) more courage. :)

Commenting on this hadeeth, Ibn Hijr (may Allaah have mercy on him) said:

“This shows that it is permitted to eat meat slaughtered by a woman, whether she is free or a slave, old or young, Muslim or of the People of the Book (i.e., Jewish or Christian), in a state of purity or otherwise, because the Prophet (peace and blessings of Allaah be upon him) told them to eat the meat she had slaughtered and did not ask for further details.”

This hadeeth also answers the question about whether any of the Sahaabiyaat (female Companions of the Prophet (peace and blessings of Allaah be upon him)) slaughtered animals.

Shaykh al-Islam Ibn Taymiyah said:

“It is permitted to eat from an animal which a man or a woman slaughters Islamically before it dies, or from meat slaughtered by a woman, even if she is menstruating, because her menstruation is not in her hand. It is permissible to eat meat from an animal which a woman slaughters Islamically before it dies, by the consensus of the Muslims.” (Al-Fataawa, 35/234).

Charging for Animal Copulation (Hadith No. 1979)

Volume 3, Book 36, Number 477 :
Narrated by Anas bin Malik (radiallaahu `anhu)
When Abu Taiba cupped the Prophet (sallallaahu `alayhi wasallam) and the Prophet (sallallaahu `alayhi wasallam) ordered that he be paid one or two Sas of foodstuff and he interceded with his masters to reduce his taxes.

Volume 3, Book 36, Number 478 :
Narrated by Ibn ‘Abbas (radiallaahu `anhu)
When the Prophet (sallallaahu `alayhi wasallam) was cupped, he paid the man who cupped him his wages.

Volume 3, Book 36, Number 479 :
Narrated by Ibn ‘Abbas (radiallaahu `anhu)
When the Prophet (sallallaahu `alayhi wasallam) was cupped, he paid the man who cupped him his wages. If it had been undesirable he would not have paid him.

Volume 3, Book 36, Number 480 :
Narrated by Anas (radiallaahu `anhu)
The Prophet (sallallaahu `alayhi wasallam) used to get cupped and would never withhold the wages of any person.

Volume 3, Book 36, Number 481 :
Narrated by Anas bin Malik (radiallaahu `anhu)
The Prophet (sallallaahu `alayhi wasallam) sent for a slave who had the profession of cupping, and he cupped him. The Prophet (sallallaahu `alayhi wasallam) ordered that he be paid one or two Sas, or one or two Mudds of foodstuff, and appealed to his masters to reduce his taxes.

Volume 3, Book 36, Number 482 :
Narrated by Abu Masud Al-Ansari (radiallaahu `anhu)
Allah’s Apostle (sallallaahu `alayhi wasallam) regarded illegal the price of a dog, the earnings of a prostitute, and the charges taken by a soothsayer.

Volume 3, Book 36, Number 483 :
Narrated by Abu Huraira (radiallaahu `anhu)
The Prophet (sallallaahu `alayhi wasallam) prohibited the earnings of slave girls (through prostitution).

Today’s Hadith:

Volume 3, Book 36, Number 484 :
Narrated by Ibn ‘Umar (radiallaahu `anhu)
The Prophet (sallallaahu `alayhi wasallam) forbade taking a price for animal copulation.

Not sure if people do this – charging for providing their male animal’s semen to another’s female animal.. but if they do, they must know it’s unlawful.

Some interesting facts:

No animal tries to attract another species of animal. The male animal does not deviate from its straight, divine path and there is no deviation found in the sexual instincts of animals. The male sperm is intended for females of the same species and no other species is taken into consideration.

Animals do not attack females belonging to another male of the same species and they do not pursue other female animals. Oviparous animals and mammals are not any different in this regard.

Why the Jews Were Cursed (Ahadith 1921 – 1922)

Bismillah.

Volume 3, Book 34, Number 426 :
Narrated by Ibn ‘Abbas (radiallaahu `anhu)
Once ‘Umar (radiallaahu `anhu) informed that a certain man sold alcohol. ‘Umar (radiallaahu `anhu) said, “May Allah curse him! Doesn’t he know that Allah’s Apostle (sallallaahu `alayhi wasallam) said, ‘May Allah curse the Jews, for Allah had forbidden them to eat the fat of animals but they melted it and sold it.”

Volume 3, Book 34, Number 427 :
Narrated by Abu Huraira (radiallaahu `anhu)
Allah’s Apostle (sallallaahu `alayhi wasallam) said, “May Allah curse the Jews, because Allah made fat illegal for them but they sold it and ate its price. “

We studied previously that when Allah forbids a thing, He forbids its price. Animal fat was haraam for the Jews. To have a way around it, they used to sell it to others and consume its price. This is wrong because of the rule mentioned in the beginning. Similarly, alcohol is forbidden for Muslims and so is its price. We can’t drink it OR sell it to non-Muslims. Its price is forbidden too.

Returning an Animal (Ahadith 1853 – 1854)

Volume 3, Book 34, Number 354 :
Narrated by Abu Said (radiallaahu `anhu)
Allah’s Apostle (sallallaahu `alayhi wasallam) forbade the selling by Munabadha, i.e. to sell one’s garment by casting it to the buyer not allowing him to examine or see it. Similarly he forbade the selling by Mulamasa. Mulamasa is to buy a garment, for example, by merely touching it, not looking at it.

Volume 3, Book 34, Number 355 :
Narrated by Abu Huraira (radiallaahu `anhu)
The Prophet (sallallaahu `alayhi wasallam) forbade two kinds of dressing; (one of them) is to sit with one’s legs drawn up while wrapped in one garment. (The other) is to lift that garment on one’s shoulders. And also forbade two kinds of sale: Al-Limas and An-Nibadh.

Volume 3, Book 34, Number 356 :
Narrated by Abu Huraira (radiallaahu `anhu)
Allah’s Apostle (sallallaahu `alayhi wasallam) forbade selling by Mulamasa and Munabadha.

Volume 3, Book 34, Number 357 :
Narrated by Abu Said (radiallaahu `anhu)
The Prophet (sallallaahu `alayhi wasallam) forbade two kinds of dresses and two kinds of sale, i.e., Mulamasa and Munabadha.

Today’s Hadith:

Volume 3, Book 34, Number 358 :
Narrated by Abu Huraira (radiallaahu `anhu)
The Prophet (sallallaahu `alayhi wasallam) said, “Don’t keep camels and sheep unmilked for a long time, for whoever buys such an animal has the option to milk it and then either to keep it or return it to the owner along with one Sa of dates.” Some narrated from Ibn Sirin (that the Prophet (sallallaahu `alayhi wasallam) had said), “One Sa of wheat, and he has the option for three days.” And some narrated from Ibn Sirin, ” … a Sa of dates,” not mentioning the option for three days. But a Sa of dates is mentioned in most narrations.

Volume 3, Book 34, Number 359 :
Narrated by ‘Abdullah bin Mas’ud (radiallaahu `anhu)
Whoever buys a sheep which has not been milked for a long time, has the option of returning it along with one Sa of dates; and the Prophet (sallallaahu `alayhi wasallam) forbade going to meet the seller on the way (as he has no knowledge of the market price and he may sell his goods at a low price).

You buy an animal (camel/sheep), you milk it, you find some flaw in it or don’t want to keep it for some reason, you still have the option to return it to the seller. Accompany it with a Sa` of dates/wheat and you’re good to go.

If you own an animal (camel/sheep etc.), don’t leave it un-milked for too long so it’s uncomfortable or unhealthy for the animal.
