Charging for Animal Copulation (Hadith No. 1979)

Ahadith 1972 – 1976 (below) are repeat and related to this post.

Volume 3, Book 36, Number 477 :
Narrated by Anas bin Malik (radiallaahu `anhu)
When Abu Taiba cupped the Prophet (sallallaahu `alayhi wasallam) and the Prophet (sallallaahu `alayhi wasallam) ordered that he be paid one or two Sas of foodstuff and he interceded with his masters to reduce his taxes.

Volume 3, Book 36, Number 478 :
Narrated by Ibn ‘Abbas (radiallaahu `anhu)
When the Prophet (sallallaahu `alayhi wasallam) was cupped, he paid the man who cupped him his wages.

Volume 3, Book 36, Number 479 :
Narrated by Ibn ‘Abbas (radiallaahu `anhu)
When the Prophet (sallallaahu `alayhi wasallam) was cupped, he paid the man who cupped him his wages. If it had been undesirable he would not have paid him.

Volume 3, Book 36, Number 480 :
Narrated by Anas (radiallaahu `anhu)
The Prophet (sallallaahu `alayhi wasallam) used to get cupped and would never withhold the wages of any person.

Volume 3, Book 36, Number 481 :
Narrated by Anas bin Malik (radiallaahu `anhu)
The Prophet (sallallaahu `alayhi wasallam) sent for a slave who had the profession of cupping, and he cupped him. The Prophet (sallallaahu `alayhi wasallam) ordered that he be paid one or two Sas, or one or two Mudds of foodstuff, and appealed to his masters to reduce his taxes.

Volume 3, Book 36, Number 482 :
Narrated by Abu Masud Al-Ansari (radiallaahu `anhu)
Allah’s Apostle (sallallaahu `alayhi wasallam) regarded illegal the price of a dog, the earnings of a prostitute, and the charges taken by a soothsayer.

Volume 3, Book 36, Number 483 :
Narrated by Abu Huraira (radiallaahu `anhu)
The Prophet (sallallaahu `alayhi wasallam) prohibited the earnings of slave girls (through prostitution).

Today’s Hadith:

Volume 3, Book 36, Number 484 :
Narrated by Ibn ‘Umar (radiallaahu `anhu)
The Prophet (sallallaahu `alayhi wasallam) forbade taking a price for animal copulation.

Not sure if people do this – charging for providing their male animal’s semen to another’s female animal.. but if they do, they must know it’s unlawful.

Some interesting facts:

No animal tries to attract another species of animal. The male animal does not deviate from its straight, divine path and there is no deviation found in the sexual instincts of animals. The male sperm is intended for females of the same species and no other species is taken into consideration.

Animals do not attack females belonging to another male of the same species and they do not pursue other female animals. Oviparous animals and mammals are not any different in this regard.

Selling the Sinful Slave Girl (Ahadith 1857 – 1858)

Bismillah.

Ahadith 1855 & 1856 are repeats. They’re a summary of most of the things we’ve learnt in the Book of Sales and Trade that are prohibited.

Volume 3, Book 34, Number 360 :
Narrated by Abu Huraira (radiallaahu `anhu)
Allah’s Apostle (sallallaahu `alayhi wasallam) said, “Do not go forward to meet the caravan (to buy from it on the way before it reaches the town). And do not urge buyers to cancel their purchases to sell them (your own goods) yourselves, and do not practice Najsh. A town dweller should not sell the goods for the desert dweller. Do not leave sheep unmilked for a long time, when they are on sale, and whoever buys such an animal has the option of returning it, after milking it, along with a Sa of dates or keeping it. it has been kept unmilked for a long period by the seller (to deceive others).

Volume 3, Book 34, Number 361 :
Narrated by Abu Huraira (radiallaahu `anhu)
Allah’s Apostle (sallallaahu `alayhi wasallam) said, “Whoever buys a sheep which has been kept unmilked for a long period, and milks it, can keep it if he is satisfied, and if he is not satisfied, he can return it, but he should pay one Sa of dates for the milk.”

Today’s Ahadith:

Volume 3, Book 34, Number 362 :
Narrated by Abu Huraira (radiallaahu `anhu)
The Prophet (sallallaahu `alayhi wasallam) said, “If a slave-girl commits illegal sexual intercourse and it is proved beyond doubt, then her owner should lash her and should not blame her after the legal punishment. And then if she repeats the illegal sexual intercourse he should lash her again and should not blame her after the legal punishment, and if she commits it a third time, then he should sell her even for a hair rope.”

Volume 3, Book 34, Number 363 :
Narrated by Abu Huraira and Zaid bin Khalid (radiallaahu `anhumaa)
Allah’s Apostle (sallallaahu `alayhi wasallam) was asked about the slave-girl, if she was a virgin and committed illegal sexual intercourse. The Prophet (sallallaahu `alayhi wasallam) said, “If she committed illegal sexual intercourse, lash her, and if she did it a second time, then lash her again, and if she repeated the third time, then sell her even for a hair rope.” Ibn Shihab said, “I don’t know whether to sell her after the third or fourth offense.”

This is for an unmarried, virgin slave girl. The punishment for a married slave girl is mentioned in Surah an-Nisa: 25.

Punishment is only prescribed when the crime is proved beyond doubt. Lashes for the first two times and selling off for even the lowest price the third time around without lashes. Why? Because if lashes don’t do her any good, changing her master and surroundings just might.

Intercourse while Fasting (Ahadith 1651 – 1653)

Volume 3, Book 31, Number 155:

Narrated Humran:

I saw ‘Uthman (radiallaahu `anhu) performing ablution; he washed his hands thrice, rinsed his mouth and then washed his nose, by putting water in it and then blowing it out, and washed his face thrice, and then washed his right forearm up to the elbow thrice, and then the left-forearm up to the elbow thrice, then smeared his head with water, washed his right foot thrice, and then his left foot thrice and said, “I saw Allah’s Apostle (sallallaahu `alayhi wasallam) performing ablution similar to my present ablution, and then he said, ‘Whoever performs ablution like my present ablution and then offers two Rakat in which he does not think of worldly things, all his previous sins will be forgiven.”

Intercourse while Fasting and its Expiation

Volume 3, Book 31, Number 156:

Narrated ‘Aisha (radiallaahu `anhaa):

A man came to the Prophet (sallallaahu `alayhi wasallam) and said that he had been burnt (ruined). The Prophet (sallallaahu `alayhi wasallam) asked him what was the matter. He replied, “I had sexual intercourse with my wife in Ramadan (while I was fasting).” Then a basket full of dates was brought to the Prophet (sallallaahu `alayhi wasallam) and he asked, “Where is the burnt (ruined) man?” He replied, “I am present.” The Prophet (sallallaahu `alayhi wasallam) told him to give that basket in charity (as expiation).


Volume 3, Book 31, Number 157:

Narrated Abu Huraira (radiallaahu `anhu):

While we were sitting with the Prophet (sallallaahu `alayhi wasallam) a man came and said, “O Allah’s Apostle (sallallaahu `alayhi wasallam)! I have been ruined.” Allah’s Apostle (sallallaahu `alayhi wasallam) asked what was the matter with him. He replied “I had sexual intercourse with my wife while I was fasting.” Allah’s Apostle (sallallaahu `alayhi wasallam) asked him, “Can you afford to manumit a slave?” He replied in the negative. Allah’s Apostle (sallallaahu `alayhi wasallam) asked him, “Can you fast for two successive months?” He replied in the negative. The Prophet (sallallaahu `alayhi wasallam) asked him, “Can you afford to feed sixty poor persons?” He replied in the negative. The Prophet (sallallaahu `alayhi wasallam) kept silent and while we were in that state, a big basket full of dates was brought to the Prophet (sallallaahu `alayhi wasallam). He asked, “Where is the questioner?” He replied, “I (am here).” The Prophet (sallallaahu `alayhi wasallam) said (to him), “Take this (basket of dates) and give it in charity.” The man said, “Should I give it to a person poorer than I? By Allah; there is no family between its (i.e. Medina’s) two mountains who are poorer than I.” The Prophet (sallallaahu `alayhi wasallam) smiled till his pre-molar teeth became visible and then said, ‘Feed your family with it.”


Volume 3, Book 31, Number 158:

Narrated Abu Huraira (radiallaahu `anhu):

A man came to the Prophet (sallallaahu `alayhi wasallam) and said, “I had sexual intercourse with my wife on Ramadan (while fasting).” The Prophet (sallallaahu `alayhi wasallam) asked him, “Can you afford to manumit a slave?” He replied in the negative. The Prophet (sallallaahu `alayhi wasallam) asked him, “Can you fast for two successive months?” He replied in the negative. He asked him, “Can you afford to feed sixty poor persons?” He replied in the negative. (Abu Huraira (radiallaahu `anhu) added): Then a basket full of dates was brought to the Prophet (sallallaahu `alayhi wasallam) and he said (to that man), “Feed (poor people) with this by way of atonement.” He said, “(Should I feed it) to poorer people than we? There is no poorer house than ours between its (Medina’s) mountains.” The Prophet (sallallaahu `alayhi wasallam) said, “Then feed your family with it.”

If a man has intercourse with his wife during the day in Ramadaan, each of them must offer expiation, which is freeing a Muslim slave. If they are unable to do that, then they must each fast for two consecutive months if she was willing. If they are unable to do that then they must feed sixty poor persons, each of them giving thirty saa’s of the local staple food, one saa’ for each poor person, half on behalf of the man and half on behalf of the woman, if they are unable to free a slave or fast. They also have to make up the fast for the day on which intercourse took place, and repent to Allaah and turn to Him, and regret it, and give it up, and ask for forgiveness, because intercourse during the day in Ramadan is a great evil and it is not permissible for anyone who is obliged to fast. End quote.
Majmoo’ Fataawa al-Shaykh Ibn Baaz (15/302).

Based on that, the amount of food that should be given to the poor person is half a saa’ of rice etc., i.e., approximately one and half kilograms.

Intimacy during Fasting (Ahadith 1644 – 1648)

Bismillah.

Volume 3, Book 31, Number 149:

Narrated ‘Aisha (radiallaahu `anhaa):

The Prophet (sallallaahu `alayhi wasallam) used to kiss and embrace (his wives) while he was fasting, and he had more power to control his desires than any of you. Said Jabir, “The person who gets discharge after casting a look (on his wife) should complete his fast.”


Volume 3, Book 31, Number 150:

Narrated Hisham’s father:

Aisha (radiallaahu `anhaa) said, “Allah’s Apostle (sallallaahu `alayhi wasallam) used to kiss some of his wives while he was fasting,” and then she smiled.


Volume 3, Book 31, Number 151:

Narrated Zainab (daughter of Um Salama) (radiallaahu `anhaa) that her mother said, “While I was (lying) with Allah’s Apostle (sallallaahu `alayhi wasallam) underneath a woolen sheet, I got the menstruation, and then slipped away and put on the clothes (which I used to wear) in menses. He asked, “What is the matter? Did you get your menses?” I replied in the affirmative and then entered underneath that woolen sheet. I and Allah’s Apostle used to take a bath from one water pot and he used to kiss me while he was fasting.”


Volume 3, Book 31, Number 152:

Narrated ‘Aisha (radiallaahu `anhaa):

(At times) in Ramadan the Prophet (sallallaahu `alayhi wasallam) used to take a bath in the morning not because of a wet dream and would continue his fast.


Volume 3, Book 31, Number 153:

Narrated Abu Bakr bin ‘Abdur-Rahman:

My father and I went to ‘Aisha (radiallaahu `anhaa) and she said, “I testify that Allah’s Apostle (sallallaahu `alayhi wasallam) at times used to get up in the morning in a state of Janaba from sexual intercourse, not from a wet dream and then he would fast that day.” Then he went to Um Salama (radiallaahu `anhaa) and she also narrated a similar thing.

The Muslim has to protect his fast from things that may invalidate it, and he has to seek reward by giving up his desires for food, drink and intercourse, as Allaah says in the hadeeth qudsi concerning the virtues of fasting: “He gives up his food, his drink and his physical desires for My sake.” (Narrated by al-Bukhaari, al-Sawm, 1761). But if he can control himself and not slip into that which would cause his fast to be invalidated, by the emission of maniy (semen) or by having intercourse, or would make his fast imperfect by the emission of madhiy (prostatic fluid), then it is permissible for him to embrace his wife in this case, because the Prophet (peace and blessings of Allaah be upon him) used to fondle ‘Aa’ishah (may Allaah be pleased with her) but he used to control his desire.

Shaykh ‘Abd al-‘Azeez ibn Baaz said:

A man may kiss, embrace and touch his wife, without having intercourse, when he is fasting. This is permissible and there is nothing wrong with it, because the Prophet (peace and blessings of Allaah be upon him) used to kiss and touch his wives when he was fasting. But if there is the fear that he may do something that Allaah has forbidden because his desire is aroused quickly, then it is makrooh for him to do that. If he ejaculates he still should not eat or drink for the rest of the day, and he has to make up the fast, but he does not have to offer kafaarah (expiation) according to the majority of the scholars. But madhiy (prostatic fluid) does not invalidate the fast, according to the more correct of the two scholarly views, because the basic principle is that the fast remains valid, and because it is too difficult to avoid. And Allaah is the Source of strength.

Ghusl before Fasting (Hadith No. 1643)

Bismillah.

Volume 3, Book 31, Number 148:

Narrated ‘Aisha and Um Salama (radiallaahu `anhumaa):

At times Allah’s Apostle (sallallaahu `alayhi wasallam) used to get up in the morning in the state of Janaba after having sexual relations with his wives. He would then take a bath and fast.

The fast of one who has intercourse with his wife at night and wakes up in the morning in a state of junub is still valid, as is the fast of one who becomes junub in his sleep, whether at night or during the day. There is nothing wrong with delaying ghusl until just before dawn. Rather fasting is invalidated by having intercourse during the day in Ramadaan, from just before dawn until after sunset.

Usually what happens is, being in the state of janaabah, people tend to delay ghusl (due to embarrassment or other reasons) and miss Fajr. This is not acceptable. One must make sure to pray on time as well.
