Never Apart (Hadith No. 2765)

Bismillah.

Volume 4, Book 53, Number 368 :
Narrated by Jubair bin Mutim (radiallaahu `anhu)
I and ‘Uthman bin ‘Affan (radiallaahu `anhu) went to Allah’s Apostle (sallallaahu `alayhi wasallam) and said, “O Allah’s Apostle! You have given to Bani Al-Muttalib and left us although they and we are of the same kinship to you.” Allah’s Apostle (sallallaahu `alayhi wasallam) said, “Bani Muttalib and Bani Hashim are one and the same.” The Prophet (sallallaahu `alayhi wasallam) did not give a share to Bani Abd Shams and Bani Naufal.
(Ibn Ishaq said, “Abd Shams and Hashim and Al-Muttalib were maternal brothers and their mother was ‘Atika bint Murra and Naufal was their paternal brother.)

The image above shows the four sons of Abd Manaf: Al-Muttalib, Hashmi, Nawfal (paternal brother) and Abd Shams. Prophet Muhammad (sallallaahu `alayhi wasallam) himself was from Hashim (as shown), Uthman ibn Affan (radiallaahu `anhu) was from Abd Shams and Jubair ibn Mut’im (radiallaahu `anhu) was from Nawfal.

When Prophet (sallallaahu `alayhi wasallam) distributed the khumus among Banu Muttalib and Banu Hashim and not the other two clans, Uthman and Jubair (radiallaahu `anhumaa) came to him with this concern – how come they got it and we didn’t when we have the same relationship to the Prophet (sallallaahu `alayhi wasallam) as them? So the Prophet (sallallaahu `alayhi wasallam) said that Banu Hashim and Banu Muttalib are one and the same – meaning (according to commentators) they were always together in kufr and Islam. Nothing separated them. That’s why they get a share and others don’t.

Distribution of War Booty: Justice (Ahadith 2759 – 2763)

Bismillah.

Volume 4, Book 53, Number 362 :
Narrated by Nafi from Ibn Umar (radiallaahu `anhu)
Allah’s Apostle (sallallaahu `alayhi wasallam) sent a Sariya towards Najd, and Abdullah bin ‘Umar (radiallaahu `anhu) was in the Sariya. They gained a great number of camels as war booty. The share of each one of them was twelve or eleven camels, and they were given an extra camel each.

Volume 4, Book 53, Number 363 :
Narrated by Ibn ‘Umar (radiallaahu `anhu)
Allah’s Apostle (sallallaahu `alayhi wasallam) used to give extra share to some of the members of the Sariya he used to send, in addition to the shares they shared with the army in general.

Volume 4, Book 53, Number 364 :
Narrated by Abu Musa (radiallaahu `anhu)
We got the news of the migration of the Prophet (sallallaahu `alayhi wasallam) while we were in Yemen, so we set out migrating to him. We were, I and my two brothers, I being the youngest, and one of my brothers was Abu Burda and the other was Abu Ruhm. We were over fifty (or fifty-three or fifty two) men from our people. We got on board a ship which took us to An-Najashi in Ethiopia, and there we found Ja’far bin Abu Talib (radiallaahu `anhu) and his companions with An-Najaishi. Ja’far (radiallaahu `anhu) said (to us), “Allah’s Apostle (sallallaahu `alayhi wasallam) has sent us here and ordered us to stay here, so you too, stay with us.” We stayed with him till we all left (Ethiopia) and met the Prophet (sallallaahu `alayhi wasallam) at the time when he had conquered Khaibar. He gave us a share from its booty (or gave us from its booty). He gave only to those who had taken part in the Ghazwa with him. but he did not give any share to any person who had not participated in Khaibar’s conquest except the people of our ship, besides Ja’far and his companions, whom he gave a share as he did them (i.e. the people of the ship).

Volume 4, Book 53, Number 365 :
Narrated by Jabir (radiallaahu `anhu)
Allah’s Apostle (sallallaahu `alayhi wasallam) said (to me), “If the property of Bahrain had come to us, I would have given you so much and so much.” But the Bahrain property did not come till the Prophet (sallallaahu `alayhi wasallam) had died. When the Bahrain property came. Abu Bakr (radiallaahu `anhu) ordered somebody to announce, “Any person who has money claim on Allah’s Apostle or whom Allah’s Apostle had promised something, should come to us.” So, I went to him and said, “Allah’s Apostle had promised to give me so much an so much.” Abu Bakr (radiallaahu `anhu) scooped up money with both hands thrice for me.” (The sub-narrator Sufyan illustrated this action by scooping up with both hands and said, “Ibn Munkadir, another sub-narrator, used to illustrate it in this way.”)
Narrated Jabir (radiallaahu `anhu): Once I went to Abu Bakr (radiallaahu `anhu) and asked for the money but he did not give me, and I went to him again, but he did not give me, so I went to him for the third time and said, “I asked you, but you did not give me; then I asked you (for the second time) and you did not give me; then I asked you (for the third time) but you did not give me. You should either give me or allow yourself to be considered a miser regarding my case.” Abu Bakr (radiallaahu `anhu) said, “You tell me that I am a miser with regard to you. But really, whenever I rejected your request, I had the inclination to give you.” (In another narration Jabir added:) So, Abu Bakr (radiallaahu `anhu) scooped up money with both hands for me and asked me to count it. I found out that It was five hundred. Abu Bakr (radiallaahu `anhu) told me to take twice that amount.

Volume 4, Book 53, Number 366 :
Narrated by Jabir bin Abdullah (radiallaahu `anhu)
While Allah’s Apostle (sallallaahu `alayhi wasallam) was distributing the booty at Al-Ja’rana, somebody said to him “Be just (in your distribution).” The Prophet (sallallaahu `alayhi wasallam) replied, “Verily I would be miserable if I did not act justly.”

Unique Virtue of `Uthman ibn `Affan (Hadith No. 2756)

Bismillah.

Volume 4, Book 53, Number 359 :
Narrated by Ibn ‘Umar (radiallaahu `anhu)
‘Uthman (radiallaahu `anhu) did not join the Badr battle because he was married to one of the daughters of Allah’s Apostle and she was ill. So, the Prophet (sallallaahu `alayhi wasallam) said to him. “You will get a reward and a share (from the war booty) similar to the reward and the share of one who has taken part in the Badr battle.”

This hadith is part of another longer narration which comes in Book 57 of Bukhari:

Narrated ‘Uthman (the son of Muhib):
An Egyptian who came and performed the Hajj to the Kaba saw some people sitting. He inquired, “Who are these people?” Somebody said, “They are the tribe of Quraish.” He said, “Who is the Shaikh among them?” The people replied, “He is ‘Abdullah bin ‘Umar.” He said, “O Ibn Umar! I want to ask you about something; please tell me about it. Do you know that ‘Uthman fled away on the day (of the battle) of Uhud?” Ibn ‘Umar said, “Yes.” The (Egyptian) man said, “Do you know that ‘Uthman was absent on the day (of the battle) of Badr and did not join it?” Ibn ‘Umar said, “Yes.” The man said, “Do you know that he failed to attend the Ar Ridwan pledge and did not witness it (i.e. Hudaibiya pledge of allegiance)?” Ibn ‘Umar said, “Yes.” The man said, “Allahu Akbar!” Ibn ‘Umar said, “Come, let me explain to you. As for his flight on the day of Uhud, I testify that Allah has excused him and forgiven him; and as for his absence from the battle of Badr, it was due to the fact that the daughter of Allah’s Apostle was his wife and she was sick then. Allah’s Apostle said to him, “You will receive the same reward and share (of the booty) as anyone of those who participated in the battle of Badr.’ As for his absence from the Ar-Ridwan pledge of allegiance, had there been any person in Mecca more respectable than ‘Uthman (to be sent as a representative). Allah’s Apostle would have sent him instead of him. No doubt, Allah’s Apostle had sent him, and the incident of the Ar-Ridwan pledge of Allegiance happened after ‘Uthman had gone to Mecca. Allah’s Apostle held out his right hand saying, ‘This is ‘Uthman’s hand.’ He struck his (other) hand with it saying, ‘This (pledge of allegiance) is on the behalf of ‘Uthman.’ Then Ibn ‘Umar said to the man, ‘Go now with this with you.’

Not taking part in the battle of Badr and still getting a share in its booty and reward was a virtue unique to Uthman (radiallaahu `anhu). He had the intention to go and fight but Prophet (sallallaahu `alayhi wasallam) asked him to stay and look after his wife, Ruqayyah (radiallaahu `anhaa). She died before the army returned victorious. So on one hand, the Prophet was happy about the win over Quraysh, he grieved the loss of his daughter.

Volume 4, Book 52, Number 227 :
Narrated by Aisha (radiallaahu `anhaa)
That she said, “O Allah’s Apostle! Your companions are returning with the reward of both Hajj and ‘Umra, while I am returning with (the reward of) Hajj only.” He said to her, “Go, and let ‘Abdur-Rahman (i.e. your brother) make you sit behind him (on the animal).” So, he ordered ‘AbdurRahman (radiallaahu `anhu) to let her perform ‘Umra from Al-Tan’im. Then the Prophet (sallallaahu `alayhi wasallam) waited for her at the higher region of Mecca till she returned.

Volume 4, Book 52, Number 228 :
Narrated by ‘Abdur-Rahman bin Abi Bakr As-Siddiq (radiallaahu `anhu)
The Prophet (sallallaahu `alayhi wasallam) ordered me to let ‘Aisha (radiallaahu `anhaa) sit behind me (on the animal) and to let her perform ‘Umra from At-Tan’im.

Volume 4, Book 52, Number 229 :
Narrated by Anas (radiallaahu `anhu)
I was riding behind Abu Talha (radiallaahu `anhu) (on the same) riding animal) and (the Prophet’s companions) were reciting Talbiya aloud for both Hajj and ‘Umra.

Volume 4, Book 52, Number 230 :
Narrated by ‘Urwa from Usama bin Zaid (radiallaahu `anhu)
Allah’s Apostle (sallallaahu `alayhi wasallam) rode a donkey on which there was a saddle covered by a velvet sheet and let Usama (radiallaahu `anhu) ride behind him (on the donkey).

Volume 4, Book 52, Number 231 :
Narrated by Nafi from ‘Abdullah (radiallaahu `anhu)
Allah’s Apostle (sallallaahu `alayhi wasallam) came to Mecca through its higher region on the day of the Conquest (of Mecca) riding his she-camel on which Usama (radiallaahu `anhu) was riding behind him. Bilal and ‘Uthman bin Talha (radiallaahu `anhumaa), one of the servants of the Ka’ba, were also accompanying him till he made his camel kneel in the mosque and ordered the latter to bring the key of the Ka’ba. He opened the door of the Ka’ba and Allah’s Apostle (sallallaahu `alayhi wasallam) entered in the company of Usama, Bilal and ‘Uthman (radiallaahu `anhum), and stayed in it for a long period. When he came out, the people rushed to it, and ‘Abdullah bin ‘Umar (radiallaahu `anhu) was the first to enter it and found Bilal (radiallaahu `anhu) standing behind the door. He asked Bilal (radiallaahu `anhu), “Where did the Prophet (sallallaahu `alayhi wasallam) offer his prayer?” He pointed to the place where he had offered his prayer. ‘Abdullah (radiallaahu `anhu) said, “I forgot to ask him how many Rakat he had performed.”

One for the Rider, Two for the Horse (Hadith No. 2510)

Volume 4, Book 52, Number 112 :
Narrated by Abu Huraira (radiallaahu `anhu)
Allah’s Apostle (sallallaahu `alayhi wasallam) said, “Horses are kept for one of three purposes; for some people they are a source of reward, for some others they are a means of shelter and for some others they are a source of sins. The one for whom they are a source of reward, is he who keeps a horse for Allah’s Cause (i.e. Jihad) tying it with a long tether on a meadow or in a garden with the result that whatever it eats from the area of the meadow or the garden where it is tied will be counted as good deeds for his benefit, and if it should break its rope and jump over one or two hillocks then all its dung and its foot marks will be written as good deeds for him; and if it passes by a river and drinks water from it even though he had no intention of watering it, even then he will get the reward for its drinking. As for the man for whom horses are a source of sins, he is the one who keeps a horse for the sake of pride and pretense and showing enmity for Muslims: such a horse will be a source of sins for him. When Allah’s Apostle was asked about donkeys, he replied, “Nothing has been revealed to me about them except this unique, comprehensive Verse: “Then anyone who does an atom’s (or a small ant’s) weight of good shall see it; And anyone who does an atom’s (or a small ant’s) weight of evil, shall see it.’ (101.7-8)

Volume 4, Book 52, Number 113 :
Narrated by Muslim from Abu Aqil from Abu Al-Mutawakkil An-Naji
I called on Jabir bin ‘Abdullah Al-Ansari (radiallaahu `anhu) and said to him, “Relate to me what you have heard from Allah’s Apostle (sallallaahu `alayhi wasallam).” He said, “I accompanied him on one of the journeys.” (Abu Aqil said, “I do not know whether that journey was for the purpose of Jihad or ‘Umra.”) “When we were returning,” Jabir (radiallaahu `anhu) continued, the Prophet (sallallaahu `alayhi wasallam) said, ‘Whoever wants to return earlier to his family, should hurry up.’ We set off and I was on a black red tainted camel having no defect, and the people were behind me. While I was in that state the camel stopped suddenly (because of exhaustion). On that the Prophet (sallallaahu `alayhi wasallam) said to me, ‘O Jabir, wait!’ Then he hit it once with his lash and it started moving on a fast pace. He then said, ‘Will you sell the camel?’ I replied in the affirmative when we reached Medina, and the Prophet (sallallaahu `alayhi wasallam) went to the Mosque along with his companions. I, too, went to him after tying the camel on the pavement at the Mosque gate. Then I said to him, ‘This is your camel.’ He came out and started examining the camel and saying, ‘The camel is ours.’ Then the Prophet (sallallaahu `alayhi wasallam) sent some Awaq (i.e. an amount) of gold saying, ‘Give it to Jabir.’ Then he asked, ‘Have you taken the full price (of the camel)?’ I replied in the affirmative. He said, ‘Both the price and the camel are for you.’ ”

Volume 4, Book 52, Number 114 :
Narrated by Anas bin Malik (radiallaahu `anhu)
There was a feeling of fright in Medina, so the Prophet (sallallaahu `alayhi wasallam) borrowed a horse called Mandub belonging to Abu Talha (radiallaahu `anhu) and mounted it. (On his return), he said, “I did not see anything of fright and I found this horse very fast.”

Today’s Hadith:

Volume 4, Book 52, Number 115 :
Narrated by Ibn ‘Umar (radiallaahu `anhu)
Allah’s Apostle (sallallaahu `alayhi wasallam) fixed two shares for the horse and one share for its rider (from the war booty).

With regard to ghaneemah (booty), it is obligatory according to sharee’ah for the imaam (leader) or the commander of the mujaahideen or the one who is responsible for them or in charge of them, to gather the booty and divide it into five equal parts, one of which is to be distributed to the groups mentioned by Allaah in the aayah (interpretation of the meaning):

“And know that whatever of war-booty that you may gain, verily, one-fifth (1/5th) of it is assigned to Allaah, and to the Messenger, and to the near relatives [of the Messenger (Muhammad)], (and also) the orphans, Al‑Masaakin (the poor) and the wayfarer” [al-Anfaal 8:41]

The other four-fifths are to be shared out among the mujaahideen who took part in the fighting, by giving one share to each foot-soldier and three shares to each horseman (one share for him and two for his horse – this is if horses were used in the fighting). This wealth is permissible and good for the Muslim army, and has been allowed for them by Allaah, as He says (interpretation of the meaning): “So enjoy what you have gotten of booty in war, lawful and good’ [al-Anfaal 8:69].

What is meant by al-khums (the one-fifth), is what referred to in the aayah [al-Anfaal 8:41] and this is this first share to be distributed. The way it is to be distributed is as follows:

1.     A share for Allaah and His Messenger, which is to be used to serve the common interest of the Muslims, not for any specific person(s). Allaah has stated that this is for Him and for His Messenger (peace and blessings of Allaah be upon him). Allaah and His Messenger have no need of it, therefore we know that it is for the slaves of Allaah. The fact that Allaah did not state that it was for anyone in particular indicates that it should be spent to serve the common interests of all. (Tafseer Ibn Sa’di, 3/169)

2.     A share for the relatives of the Prophet (peace and blessings of Allaah be upon him) from Bani Haashim and Bani al-Muttalib. They are all equally entitled to it, rich and poor, male and female.

3.     Orphans – those who have lost their fathers whilst they are still young i.e., before the age of puberty.

4.     The poor and needy.

5.     The wayfarer, i.e. travellers who are cut off and need money in order to get back home.
